Objectif de PROEQUIPE reminds you of the legal and administrative formalities to be completed when hiring a new employee in France:
Employment contract
This document formalizes the agreement between employer and employee, and sets out the rights and obligations of each party.
Mandatory information :
- Working hours
- Compensation
- Working hours
- Type of contract (permanent, fixed-term, temporary, etc.)
- Company collective agreement
Declaration prior to hiring (DPAE)
To be completed before the employee is hired, or on the day of hiring at the latest. Penalties for failing to complete the DPAE: Concealment of salaried employment
The personnel register
Mandatory for the first employee hired. Penalties for non-compliance: 750 euro fine for each employee concerned.
Information and prevention visit (VIP)
The VIP has replaced the pre-employment medical examination. Maximum time limit: 3 months
Provident and mutual insurance
Unlike company mutual insurance, provident insurance is in principle optional. However, it is compulsory in the following cases: for managerial staff; when it is provided for in a collective agreement or branch agreement. On the other hand, it is recommended and customary to set up a provident contract. Since 2016, all employers in the private sector have been obliged to provide their employees with a group health insurance plan, and to contribute at least 50% of the cost of the premiums.
The BTP card
This is an individual, secure card that identifies any employee working on a site. It makes it easier to combat illegal employment and unfair social competition. Validity: 5 years Penalty for failure to declare: €4,000 fine per employee. Further information: https://entreprendre.service-public.fr/vosdroits/F33599
We recommend that you carry out these formalities before the employee actually joins the company, so as not to miss out on any of them.
As a temporary employment agency specializing in industry, Proequipe is responsible for implementing all these procedures in the projects we develop.
